释义 | 當然公訴書 Commonly known as ‘voluntary bill’. An indictment which is preferred or consent to be preferred as directed by a judge of the Court of First Instance in the absence of any committal proceedings: Criminal Procedure Ordinance (Cap 221) s 24A(1)(b). This procedure is regarded as exceptional and should only be employed where there is good reason in the interests of justice to depart from the normal committal proceedings: Practice Direction 9.2. Applications for a voluntary bill are normally presented where: the accused charged with an indictable offence has been committed for trial, the indictment against him may include, either in substitution for or in addition to the original counts, any counts founded on facts or evidence disclosed in any depositions: Criminal Procedure Ordinance (Cap 221) s 24A(2); an indictment which has been filed in consequence of committal proceedings was quashed, a fresh indictment may be preferred.
