| 释义 | 連同批予的特許 A combination of a permission to do something which would not otherwise be allowed, with the granting or conferral of an interest in a corporeal hereditament. Also known as licence coupled with an interest in land. It arises where a right to enter land is granted in order to support an interest in the land. It was suggested that the interest that may support a licence may not be itself proprietary in nature, but these suggestions have been doubted, for then many licences would qualify within this category: Hurst v Picture Theatres Ltd [1915] 1 KB 1; Hounslow LBC v Twickenham Garden Developments Ltd [1971] Ch 233. The creation and termination of a licence coupled with a grant is dependent on the interest to which it is attached. The interest must be validly created, and during the subsistence of the interest the licence cannot be revoked. If the interest can be assigned so as to bind third parties, the licence will also be assignable: Nield Hong Kong Land Law (2nd Ed, Longman) ch 18 p 488.
