| 释义 | 衡平法 1.Equity is the system of law which, prior to the fusion of the administration of law and equity effected in England by the Supreme Court of Judicature Acts 1873 and 1875, was administered by the Court of Chancery in England: Halsbury’s Laws of Hong Kong, Vol 11, Equity [165.002]. This system of law mitigates the harshness of the strictness of the common law. Equitable remedies are discretionary and are usually only available where damages are an inadequate remedy. 2. A right recognised by a court of equity, based on ethical concepts, and justifying in certain cases the judicial intervention of that court. The remaining interest in the assets of a corporation that remains after deducting its liabilities. The amount of a business is total assets less total liabilities. 3. The residual value of the total initial and variations margins in a futures trading account, assuming its liquidation at the current market price.
