| 释义 | 特赦權 The power of the Hong Kong SAR to exercise mercy to a person who has been convicted and sentenced for an offence by a court. This power is exercised by the Chief Executive under the Basic Law art 48(12) and involves granting a pardon or remitting all or part of a sentence. The power is commonly exercised in relation to life sentences or indefinite detentions, following the recommendation or advice of the Long Time Sentences Review Board, and can also be used where a miscarriage of justice or other matter has arisen which cannot appropriately be addressed by the courts. See also Pardon. 香港特別行政區對由法庭定罪及判形的人所行使的特赦權。由行政長官根據基本法第48(12)條行使的權利，涉及赦免或減免全部或部分形罰。就長期刑罰上訴委員會的建議或意見，通常就有關終身監禁或無期拘留行使此權力，如有司法不公或其他不能由法庭適當地解決的事情發生，也可運用此權。另見 Pardon。 |
