A title obtained against the Government to land by virtue of the Limitation Ordinance (Cap 347) ss 7(1), 17: Land Acquisition (Possessory Titles) Ordinance (Cap 130) s 2. A title to land obtained by adverse, undisturbed possession for the required statutory period. Possessory title or good holding title is one which looks back to the origin of ownership, namely possession. The dispossessor will gain title by merely exercising such right or by seeking a declaration from the court of his rights as owner to the land based on the adverse possession: Man Kam Tong v Man Lin Tai [1984] HKLR 181, [1985] 2 HKC 299. The relevant statutory periods are 60 years in respect to actions by Government, and 20 years in respect of other actions, where the right of action accrued before 1 July 1991: s 7. Where the right of action accrued after 1 July 1991, the limitation period is 12 years: Limitation Ordinance (Cap 347) s 38A. See also Adverse possession; Possession; Title.
