释义 | 藉土地的描述隱含的地役權 An easement implied where there is no express grant or reservation contained in the instrument, but the description of the land implies that an easement must have been intended to be granted or reserved. For example, at common law, words in a conveyance that describe land as abutting a road or laneway owned by the vendor give rise to an implied right of way over that road or laneway. This principle is similar to the doctrine of ‘apparent accommodations’ as both are founded upon the principle that a man shall not derogate from his grant: Halsbury’s Laws of Hong Kong (2001 Reissue) Vol 16, Land [230.0547], [230.0548].
