释义	文字上的合約 1. Formerly, a contract expressed by the parties in words, whether oral or written, as opposed to one made wordlessly but whose terms are words supplied by the law. 2. The term is increasingly used to mean a contract made entirely by spoken, not written, words. ‘Verbal contract’ is not a technical term. Despite modern tendency to treat ‘verbal’ and ‘oral’ as synonyms, until the older sense of ‘verbal’ dies out ‘oral contract’ is preferable for this meaning. See also Contract. 1.　往昔指由當事人以語言文字作出的明示合約（不論是口頭或書面的），與以非語言文字的方式訂立的合約相對（此等合約藉法律提供的語言文字作為其條款）。　　2.此用語漸趨指完全藉口頭而非書面的語言文字而訂立的合約。「文字上的合約」並非術語。現行趨勢是將「文字上」及「口頭」當作同義詞，但就其涵義而言，直至「文字上」一用語較舊的涵義不再存在，「口頭合約」一用語是較為可取的。另見 Contract。
