释义	安全的工作系統 A system or mode of work which in the circumstances makes adequate provision for the safety of workers and which, if carried out with reasonable care, will protect the workers from foreseeable risks of injury: Winter v Cardiff Rural District Council [1950] 1 All ER 819. All possible and practical precautions against necessary risks must be taken. The employer must provide and maintain a reasonably safe system, taking into account the inherent dangers of the work: Wilsons & Clyde Coal Co v English [1938] AC 57; Mak Kwai Yin v USA Fur Processing Ltd [1994] 1 HKC 485. It is the duty of every employer to provide and maintain plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health: Factories and Industrial Undertakings Ordinance (Cap 59) s 6A(2)(a). Where safe systems of work are available, failure to use them may be evidence of negligence on the employer’s part: Sun Wan Co v Ng Kam [1988] HKC 358 (CA); General Cleaning Contractor v Christmas [1953] AC 180, [1952] 2 All ER 1110 (HL). Whether the employer has provided a safe system of work or given sufficient warnings or notice to ensure his employee’s safety are questions of fact: Pape v Cumbria County Council [1992] 3 All ER 211.
