释义 | 分權共有 A type of co-ownership where two or more persons own distinct interests in the same piece of property. The tenants in common hold undivided shares, possessing the property in common and without exclusive possession of any part of it. A tenancy in common in land may exist either at law or in equity. It requires neither unity of title, interest nor time, but only unity of possession: Challis’s Law of Real Property (3rd Ed) p 368 et seq. A tenancy in common will be created by severance of joint tenancy, or by grant or devise: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0811]. The Government lease of land on which a multi-storey building is constructed is held by all those referred to as ‘owners’ as tenants in common: Merrilong Dyeing Works Ltd v Chiu Shu Choi [1984] 1 HKC 535, [1990] 1 HKLR 385 (CA). A tenancy in common may be terminated by union of interests in one person, by expiry of the Government lease, or by partition: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0815]-[230.0817].
