释义 | 法典編篡法律 Legislation which collates and restates all the relevant statute and case law in a given area, so as to become the complete statement of the law in the area. Codifying legislation should be given its ordinary meaning, unless there is real doubt: Bank of England v Vagliano Brothers [1891] AC 107 (HL); R v Smurthwaite [1994] 1 All ER 898 (CA). If an ambiguity appears from a provision of the code, it is permissible to resort to the antecedent common law in order to resolve the ambiguity: Mellifont v A-G (Qld) (1991) 173 CLR 289, 104 ALR 89. 在某個法律範疇結集及重申一切有關成文法及判例成為該個法律範疇的法律匯編。法典編篡法律應按字面解釋,除非確有懷疑之處: Bank of England v Vagliano Brothers [1891] AC 107 (上議院); R v Smurthwaite [1994] 1 All ER 898(英國上訴法院)。遇有法典條文出現歧義,可追溯所本的普通法澄清歧義: Mellifont v A-G (Qld) (1991) 173 CLR 289, 104 ALR 89。 |
