释义 | 參與犯罪人 A person who participates in a crime. A person may participate in a crime in two ways: by personally committing the actus reus or part of the actus reus (the ‘principal offender’); or by participating in the principal’s crime by instigating, encouraging, or assisting the principal to commit this crime (the ‘accessory’). An accomplice is guilty and is liable to the offence as a principal offender: Criminal Procedure Ordinance (Cap 221) s 89; Wong Hoi v R [1966] HKLR 386; R v Mok Wei-Tak [1986] HKLR 1054. Evidence given by an accomplice is subject to close scrutiny by court and accomplice warning is necessary: R v Chan Shuet Fun [1995] 1 HKC 360; S-J v Lee Wai Man [1999] 4 HKC 499; HKSAR v Fun Tsz Yin Benny & Anor [2002] 2 HKC 406.
