释义 | 保護國 A sovereign and independent state that has placed itself by treaty under the protection of a stronger state, usually leaving foreign affairs and defence in the control of the protecting state. A protectorate retains control over most of its internal matters, and has personality in international law: Rights of Nationals of the United States of America in Morocco (US v France) (1952) ICJ Rep 176, ICJ. The extent of the powers of a protecting state depends upon the treaty of protection and the conditions under which the protectorate has been recognised by third powers against whom it intends to rely on the treaty: Tunis and Morocco Nationality Decrees case 1923 PCIJ ser B No 4. Also known as ‘protected state’.
