释义	贖回權 The equitable right of a mortgagor of property to have an unencumbered title to the property restored once the mortgage is paid out. The mortgagor may deal with the property in any way consistent with the rights of the mortgagee. The right continues notwithstanding that he fails to pay the debt in accordance with the proviso for redemption. His right or equity of redemption is not strictly an equitable estate or interest, although it is in the nature of an equitable interest. This right arises from the transaction being considered as a mere loan of money secured by a pledge of the estate. Any provision inserted in the mortgage to prevent redemption on payment of the debt or performance of the obligation for which the security was given or which allows the mortgagee to return the property encumbered is termed a clog or fetter on the equity of redemption, and is void: Samuel v Jarrah Timber and Wood Paving Corp [1904] AC 323 (HL). The right to redeem is so inseparable an incident of a mortgage that it cannot be taken away by an express agreement of the parties that the mortgage is not to be redeemable or that the right is to be confined to a particular time or to a particular description of persons: Esso Petroleum Co Ltd v Harper’s Garage (Stourport) Ltd [1968] AC 269, [1967] 1 All ER 699 (HL). The right of redemption is inviolable: Biggs v Hoddinott [1898] 2 Ch 307.
