The continued absence of a child from school without lawful excuse. There may be failure to attend regularly when the child frequently arrives after the attendance register is closed: Hinchley v Rankin [1961] 1 All ER 692, 1 WLR 421. A child who is sent to school dressed in such a way (a girl dressed in trousers) that it is known that the head teacher will, as a matter of discipline, refuse the child admission, fails to attend school regularly: Spiers v Warrington Corp [1954] 1 QB 61, [1953] 2 All ER 1052. Statutory provisions provide procedures for dealing with truancy. For example, the Director of Education has the power to serve upon a parent of a child an attendance order requiring him or her to cause the child to attend regularly as a pupil the primary school or secondary school named in the order: Education Ordinance (Cap 279) s 74. See also Exemption; Parental duty. n. |
