释义 | 敵意意圖 The mental element which may render an otherwise innocent act criminal or tortious. In an action for battery, a plaintiff generally need not show any hostile intent on the part of the defendant: Boughey v R [1986] 161 CLR 10. However, where the action of the defendant is motivated by hostility, an otherwise innocent act, such as patting another on the shoulder to attract attention, may become a battery: Wilson v Pringle [1986] 2 All ER 440, [1987] QB 237 (CA); Collins v Wilcock [1984] 3 All ER 374, 1 WLR 1172 (DC). 可令致在其他情況下無罪的作為成為刑事或侵權行為的心理元素。在毆打的訴訟中,原告人一般無須證明有關被告人一方的敵意意圖:Boughey v R [1986] 161 CLR 10。但如該被告人的行為是因敵意所引起,則在其他情況下無罪的作為(例如輕拍另一人的肩膀以引起注意),可構成毆打罪:Wilson v Pringle [1986] 2 All ER 440, [1987] QB 237(芵國上訴法院);Collins v Wilcock [1984] 3 All ER 374, 1 WLR 1172(英國地方法院)。 |
