释义 | 破屋而入 Entering effected by way of forcible and violent means: Janway Industrial Co Ltd v Asian Eagle Insurance Co Ltd [1985] 2 HKC 433. Breaking and entering another person’s house may be justified as it was done to prevent that person murdering other(s): Handcock v Baker (1800) 2 Bos & P 260. In executing writs of possession, a bailiff may break into the house: Semayne’s case (1604) 5 Co Rep 91a. The elements of the offence are that the accused entered a dwelling house with any part of the body or an instrument, without the owner’s consent, intending to commit a felony inside (R v Pearson (1910) 4 Cr App R 40); and then either actually or constructively broke out of the house (R v Payne (1887) 13 VLR 359).
