单词 Wear and tear
Deterioration or want of repair of premises occurring during a tenant’s occupation and attributable to use by the tenant, the actions of third parties, or natural forces. The terms of a lease usually exempt reasonable or fair wear and tear from the tenant’s covenant to repair. However, the effect of the exception depends upon the particular words of the covenant to be construed, and, if proof is given that the premises are not in good repair and condition, the onus is on the tenant to prove that the matters complained of result from the fair wear and tear excepted: Brown v Davies [1958] 1 QB 117, [1957] 3 All ER 401 (CA). See also Covenant to repair; Fair wear and tear; Reasonable wear and tear; Tenant.
Covenant to repair; Fair wear and tear; Reasonable wear and tear; Tenant。
