The carrier does not accept these declarations, except for the purpose of calculating freight and for that purpose only. Under such a clause, the consignee may be exonerated from liability in case of any discrepancy in the weight, contents or value of the closed packages if disclosed after unloading. However, it does not destroy the effect of the words ‘in apparent good order and condition’ as a representation that the cargo is in good external condition apparent on a reasonable inspection: River Gurara (Owners of Cargo lately laden on Board) v Nigerian National Shipping Line Ltd [1998] QB 610 (CA). The mere production of such bill of lading does not afford prima facie evidence that such cargo has been shipped. Further evidence is required to prove that the cargo detailed by the shipper has been shipped: Impex Co v General Steam Navigation Co Ltd [1922] 13 Ll L Rep 199.
