释义 | 不存在的一方 A person named on a negotiable instrument who does not, as a matter of fact, have an existence physically (in the case of an individual), or in law (in the case of a company). A non-existing person does not exist at the time the bill or note is drawn; it is not sufficient that the person existed at some time before then: Clutton v Attenborough & Son [1897] AC 90 (HL). It includes one, whether existing or not, whose name has been placed on an instrument merely by way of pretence, not with the intention that that person should be paid, but for the purpose of deception: Bank of England v Vagliano Bros [1891] AC 107 (HL); United Links International v The Price Co [1994] 2 HKC 617. Where the payee is a fictitious or non-existing person, the bill may be treated as payable to bearer: Bills of Exchange Ordinance (Cap 19) s 7(3).
