释义 | 減責神志失常 In criminal law, an abnormality of the mind that substantially impairs the mental responsibility of an accused for acts or omissions that caused the death of a person, arising from a condition of arrested or retarded development of the mind or any other inherent cause, or induced by disease or injury: R v Byrne [1960] 2 QB 396, All ER 1; HKSAR v Leung Wai Chung [1999] 2 HKC 471 (CA). Where a person kills or is a party to a killing of another, he will not be convicted of murder if he was suffering from such abnormality of mind: Homicide Ordinance (Cap 339) s 3(1). In the event that the accused can bring himself within this provision, he is liable to be convicted of manslaughter rather than murder: s 3(3).
