释义	罰款保證書 A double bond in which the obligation provides for payment of a higher sum than that payable by the obligor had the condition in the bond been fulfilled. The higher sum is in the nature of a penalty. A court of equity will regard the penalty in a penalty bond as securing not only the repayment of the stated principal and interest, but also repayment of subsequent interest down to the date of actual payment of the principal. This is so even if the bond contains no stipulation for interest payments beyond the day fixed by the bond: Re Dixon; Heynes v Dixon [1900] 2 Ch 561 (CA). See also Bond; Double bond; Obligor. 一種雙重保證書，所訂的責任規定，保證書中的條件如已符合，則須支付一筆數額比義務人應付款項的數額為高的款項，而較高數額的款項，即屬罰款性質。衡平法院將視罰款保證書中的罰款不但保證訂明的本金及利息將獲償還，還保證計算至實際償付本金的日期的其後利息亦將獲清償，即使保證書內並沒有就其所訂的日期以外的利息支付作出規定亦然：Re Dixon; Heynes v Dixon [1900] 2 Ch 561。另見 Bond; Double bond; Obligor。
