释义 | 普通法的抗辯 A defence to an offence where the defendant acts from an honest and reasonable mistake as to existence of facts, which if true, would have made the acts innocent. The defendant will not be guilty of the offence: A-G v Fong Chin Yue & Ors [1995] 1 HKC 21. The defence applies in respect of offences involving proof of knowledge and strict liability offences: A-G v Fong Chin Yue & Ors, supra. The onus is on the prosecution to prove beyond reasonable doubt that no honest and reasonable belief on part of defendant: R v Lam Nai Sum Robin & Anor [1991] 2 HKC 582.
