| 释义 | 積極性地役權 An easement which confers on the owner or occupant of the dominant tenement a positive right to do something on the servient tenement. The positive easement is a right of way. In addition, positive easement also includes the rights of the owner to place advertisement boardings on the servient tenement (Pao Lung Yun, Louis v Peter Tsai [1959] HKDCLR 49), to affix telephone wires to buildings, to fix a name plate or a sign board upon the premises: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0515]. A positive easement is also referred to as ‘affirmative easement’: [230.0509].
