Special trust |
A trust which itself imposes duties on the trustees, for example, a trust for sale; such trusts may be either ministerial or discretionary, the former merely requiring the application of ordinary intelligence and business aptitude by the trustee, the latter calling for a greater element of judgment and discretion, as where it lies with the trustee to determine how much of the income of the trust property should be paid to each beneficiary: Hotung & Anor v Ho Yuen Ki [2002] 4 HKC 233. See also Trust. |
