释义 | 海盜 1. A person guilty of acts of piracy, ie a person who commits acts of violence, detention or depredation indiscriminately for his or her own ends, usually in places beyond the jurisdiction of any particular country. Pirates do not include people who are simply operating against the property of a particular country or for a public political end, such as engaging in warfare or establishing a government at times of civil commotion. Pirates are regarded as hostes humani generis (enemies of the human race) and every state may seize and prosecute them: United Nations Convention on the Law of the Sea 1982 arts 105, 107. 2. A person who without legal permission plunders other vessels indiscriminately on the high seas for the person’s own ends and is not operating only against the property of a particular state for a political end: Republic of Bolivia v Indemnity Mutual Marine Assurance Co Ltd [1909] 1 KB 785.
