释义 | 庭外認許 Informal statements against a party’s interest made by words by the party of the truth of its contents. Out of court admissions may be made by express written or oral statements. The accused cannot call evidence of a third party’s out of court admission of guilt in order to establish his own innocence: Teper v The Queen [1952] AC 480. In a civil case, out of court admissions by co-parties in legal proceedings are not admissible against a joint party simply by virtue of their joinder as parties: for example Rutherford v Richardson [1923] AC 1 (HL).
