取消 The making void or annulling, particularly of an instrument or transaction.
Bills of Exchange - One of the ways to discharge a bill of exchange. The cancellation has to be intentional by the holder or his agent and is apparent on the bill: Bills of Exchange Ordinance (Cap 19) s 63(1). Any party liable on a bill may be discharged by the intentional cancellation of his signature by the holder or his agent. In such a case, any indorser who would have had a right of recourse against the party whose signature is cancelled is also discharged: s 63(2). Deeds - Destruction or defacement of a deed or bond, or the seal of a deed, with the intention of rendering it void. A deed is also cancelled if a person who is to benefit under it alters it materially. A cancelled deed is void, but it is not void ab initio, as the cancellation has no retrospective operation. A cancelled deed cannot be put in evidence to maintain an action to enforce any obligation created by it: Lord Ward v Lumley (1860) 5 H & N 656. It may, however, be put in evidence to prove that before it was cancelled it operated as a conveyance of some estate or interest in property: Re Hancock, Hancock v Berrey (1888) 57 LJ Ch 793.
