单词 Autonomy
The principle that a letter of credit is a separate transaction from the sale or other contract on which it may be based, and banks are in no way concerned with or bound by such contracts, even if the letter of credit contains a reference to such contracts: Uniform Customs and Practice for Documentary Credits (UCP 500) art 3. A letter of credit is like a bill of exchange given for the price of the goods and it must be honoured: Power Curber International Ltd v National Bank of Kuwait SAK [1981] 3 All ER 307, 1 WLR 1233 (CA). All parties concerned deal in documents only, not in the goods, services or other performance requirements of the underlying contract. See also Letter of credit.
Power Curber International Ltd v National Bank of Kuwait SAK [1981] 3 All ER 307, 1 WLR 1233(英國上訴法院)。 另見 Letter of credit。n.
