| 释义 | 擅自處理 Fr – by his own wrong. An executor de son tort (wrongful executor) is any person who, to the defrauding of creditors or without full valuable consideration, obtains, receives, or holds any movable or immovable property of a deceased person or effects the release of any debt of liability due to the estate, is chargeable as executor in his own wrong: Halsbury’s Laws of Hong Kong, Vol 27, Wills, Probate, Administration and Succession [425.446]. Occasionally, it is used to describe a personal representative who improperly administers the assets of the estate. This is frequently described as intermeddling with the property of the deceased: Estate Duty Ordinance (Cap 111) s 24; Mellows, The Law of Succession (5th Ed, Butterworths) p 384. A trustee de son tort (wrongful trustee) is a person who without proper authority acts in the capacity of a trustee in relation to the property of a living person.
