释义 | 嚴重疏忽 A conscious and voluntary act or omission performed without intent to cause death or grievous bodily harm but which involved such a great falling short of the standard of care which a reasonable person would have exercised and such a high risk that death or grievous bodily harm would follow that the act or omission merits criminal punishment: Akerele v R [1943] AC 255, 1 All ER 367 (PC). The negligence must be more than a matter of compensation between the parties and must show such disregard for the life and safety of others as to amount to a crime: Andrews v DPP [1937] AC 576, 2 All ER 552. Gross negligence causing death may amount to manslaughter: Andrews v DPP, supra. The test for gross negligence is objective: R v Adomako [1994] 3 All ER 79, Crim LR 757, [1995] 1 AC 171 (HL).
