| 释义 | 戒嚴令 A system of national law promulgated by the Central People Government (‘CPG’) to govern the civilian population in times of war or emergencies. This is usually declared by an order signed by the President, known as the Order of the President: PRC Constitution 1982 art 80. It allows the commanders of the People’s Liberation Army to take control of the proclaimed area and use military force. In the event that the Standing Committee of the National People’s Congress decides to declare a state of war or, by reason of turmoil within the Hong Kong SAR which endangers national unity or security and is beyond the control of the government of the Region, decides that the Region is in a state of emergency, the CPG may issue an order applying the relevant national laws in the Region: Basic Law art 18. It is likely that Martial law would be applied to the Hong Kong SAR in the sense of ‘relevant national laws’.
