释义 | 船舶抵押借款 A contract in the nature of a mortgage on a ship by which a ship owner pledges a ship or the keel on bottom of the ship, pars pro toto (part for the whole) as security for a loan which allows the vessel to complete a voyage. If the ship is lost in the course of the voyage or during the limited time by any of the maritime perils enumerated in the contract, the lender will lose the money advanced. Bottomry can include a charge on the ship’s freight and cargo. When the loan is made only on the cargo on board which are to be sold or exchanged in the course of the voyage, the guarantee is termed a ‘respondentia bond’: Cargo ex Sultan (1859) Sw 504, 166 ER 1235. Bottomry takes priority over all mortgages: The Duke of Bedford (1829) 2 Hag Adm 294; 166 ER 251. Any claim arising out of bottomry shall be heard and determined by the Admiralty jurisdiction of the Court of First Instance: High Court Ordinance (Cap 4) s 12A(2)(q). Actions of bottomry are brought for the purpose of enforcing bottomry bonds: Cargo ex Sultan, supra. Also known as ‘bottomree bond’, ‘bummaree bond’ or ‘bottomry bill’.
