| 释义 | 立法有效性 Legislation that has a legitimate or authorised source of power and therefore is valid and intra vires. The legislative power of the Hong Kong Special Administrative Region is subject to constitutional supervision by the Central People’s Government and by the court. If the Standing Committee of the National People’s Congress (NPCSC) considers that any law enacted is not conformed with the Basic Law regarding affairs within the responsibility of the Central Authorities or regarding the relationship between the Central Authorities and the Hong Kong SAR, the NPCSC may return the law in question, which is deemed to be invalidated: Basic Law art 17. For the judicial control, the court has a new constitutional supervisory jurisdiction to examine whether the alleged provisions are consistent with the Basic Law, if the provisions are found to be inconsistent, the court may declare them to be void: Basic Law art 160; Ng Ka Ling & Ors v Director of Immigration [1999] 1 HKLRD 315 (CFA). 合法或具有授權權力根源的立法機關，因此是有效而在權限之內。香港特別行政區的立法權是受中央人民政府及法院的憲法監管所管限。全國人民代表大會常務委員會如認為香港特別行政區立法機關制定的任何法律不符合基本法關於中央管理的事務及中央和香港特別行政區的關係的條款，可將有關法律發回，並視為無效：《基本法》第17條。就司法控制而言，法院有新憲法的監管司法管轄權，以查核所指稱的條文是否與基本法相符，如與基本法不相符，法院可宣稱該等條文無效：《基本法》第160條；Ng Ka Ling & Ors v Director of Immigration [1999] 1 HKLRD 315 （終審法院）。 |
