For the offence of blackmail, demanding money by the use of the menaces to reinforce the demand: Theft Ordinance (Cap 210) s 23(1)(b). The offence can be committed by speech, writing or other conduct and may be explicit or implicit provided that a reasonable man would understand that a demand was being made: R v Clear [1968] 1 QB 670, 1 All ER 74 (CA). The demand need not necessarily be an explicit demand and it may be couched in terms of a request and whether such conduct constitutes a demand is an issue for the jury: HKSAR v Fung Cheuk Sang [1999] 3 HKLRD 660 (CA). There must be menaces which are of such a nature and extent that the mind of an ordinary person of stability and courage might be influenced or made apprehensive so as to accede unwillingly to the demand: R v Clear, supra.
