A document, whether contract (including a negotiable instrument) or conveyance, is delivered up to be cancelled when it has been obtained in circumstances which are such as to make it void or voidable, and one party to the transaction may be entitled to have it rescinded or set aside. The Court of First Instance and, within the limits provided, the District Court, have the power to order the delivery up of document: High Court Ordinance (Cap 4) s 12(2); District Court Ordinance (Cap 336) s 37(1)(d). Equity does not interfere to order the document to be cancelled when it is founded on an illegal consideration or otherwise, and the defect appears on the face of the document: Hoare v Bremridge (1872) 8 Ch App 22 (CA). Where the defect does not appear on the face of the document, the party desiring to defeat it may anticipate the danger of the document being used against him and institute an action to have the document delivered up to be cancelled: Bishop of Winchester v Fournier (1752) 2 Ves Sen 445. 2. Delivery up may also be ordered in respect of material infringing a claimant’s rights. An equitable relief usually granted in actions for infringement of copyright and design right and passing off. Order for delivery up infringing copy: Copyright Ordinance (Cap 528) s 109. Such relief is granted by way of an injunction.
