释义 | 部分固定 The process by which a floating charge over company assets becomes fixed in relation to some of the asset pool subject to the charge. The parties to a charge may make provision for the floating charge to become fixed, or to ‘crystallise’ on the happening of a defined event: Re Brightlife Ltd [1987] 1 Ch 200, [1986] 3 All ER 673. Partial crystallisation cannot occur unless specifically sanctioned in the terms agreed between chargor and chargee: Evans v Rival Granite Quarries Ltd [1910] 2 KB 979 (CA). The appointment of a receiver is one of the events which causes a floating charge to crystallise.
