| 释义 | 佔用人 1. In relation to a tenancy, the tenant and, in relation to a licence, the licensee: Halsbury’s Laws of England, Vol 27(1) (4th Ed, Reissue) Landlord and Tenant, para 185 n 4. A person in actual possession of, or taking up a place in, an area. It encompasses a degree of control: Wheat v E Lacon & Co Ltd [1966] AC 552. 2. At common law, exclusive occupation was not necessary to constitute a person an occupier, and a person could be treated as such even though he had no right to occupation provided that he enjoyed a sufficient control of the premises to exclude other persons generally: Lee Tat-man v The Queen [1964] HKLR 605. 3. The term refers to both the actual occupier of the premises and the person running the business carried on in the premises: Air Pollution Control (Furnaces, Ovens and Chimneys) (Installation and Alteration) Regulations (Cap 311A) reg 11; R v Cabot Plastics Hong Kong Ltd [1992] 1 HKC 465. 4. When a tenancy comes to an end, an occupier, in relation to any premises, means any person lawfully residing in the premises or part of them at the termination of the former tenancy: Halsbury’s Laws of England, Vol 27(1) (4th Ed, Reissue) Landlord and Tenant, para 547, n 9. 5. A tenant, sub-tenant or other person in lawful occupation of a flat, but does not include an owner of that flat: Building Management Ordinance (Cap 344) s 2.
