| 释义 | 誘因 An act of compulsion by force or threat of force, or some act of persuasion aimed at ensuring that an act is committed which amounts to a contravention. Intent, based on knowledge of the essential elements of the contravention, must be proved. See also Counsel; Procure. Contract - That which motivates or persuades a person to enter a contract: F E B Finance Ltd v Yea Kwong Yu [1988] HKLY 403. If a material representation is made which is calculated to induce the representee to enter into a contract and that person enters into the contract, there arises a fair inference of fact (although not an inference of law) that he or she was influenced by the statement. Opportunity of discovering falsity of representation is not a defence: Welltech Investment Ltd v Easy Fair Industries Ltd [1996] HKLY 270. See also Misrepresentation; Offer. Criminal law - A persuasion of temporal or worldly as opposed to moral or religious character aimed at producing some willing action on the part of an accused, by a person with authority. Merely telling a suspect that he is not believed does not constitute inducement: R v Wan Chung Wah (CACC 237/88, unreported). A confession made as a result of an inducement may be rendered unreliable and be inadmissible: R v Sang [1979] 2 All ER 1222, [1980] AC 402 (HL); S-J v Lam Tat Ming & Anor [2000] 2 HKLRD 431 (CFA).
