释义 | 在整份文書的範圍內的規則 In contract law, the rule is adopted for ascertaining the issue in question from a written instrument as a whole. Parties’ intention of a contract shall be ascertained within the four corners of the contract document; however, the court could look at all the surrounding circumstances if the parties’ intention could not be ascertained from the contract with any degree of clarity: S-J v Wing Lung Wai Community & Ors [1999] 3 HKC 580 (CA). In considering whether an authority is given by the power of attorney, it has to show that upon a fair construction of the power of attorney as a whole the authority in question is within the four corners of it: Lo Shea Chung v Lo Hung Biu & Anor [1997] 2 HKC 723 (CA). The rule is also applied by the court in dealing with appeal: Emerson Radio Corp v CIR [1998] 3 HKC 427.
