释义 | 信託基金 An amount of property, assets, money or donations that is administered by a trustee for the benefit of another. All moneys, property and securities received or held by any trust company in a fiduciary capacity must always be kept distinct from those of the company and in separate accounts, and so marked in the books of the company for each particular trust as always to be distinguished from any other in the registers and other books of account to be kept by the company, so that at no time should trust moneys form part of or be mixed with the general assets of the company; and all investments made by the company as trustee must be so designated that the trusts to which such investments belong can be readily identified at any time: Trustee Ordinance (Cap 29) s 89. Trust money or property which has been wrongfully alienated or converted in breach of trust, or the money or property into which it has been converted, can be followed and recovered so long and so far as it is capable of being identified or disentangled, unless the money or property has come into the hands of a purchaser for valuable consideration without notice of the trust: Ministry of Health v Simpson [1951] AC 251, [1950] 2 All ER 1137 (HL).
