| 释义 | 刑罰 Punishment attracted by reason of offending the law. The offence of murder attracts a mandatory penalty of imprisonment for life. The constitutionality of the punishment of murder has been considered to be not arbitrary: Lau Cheong v HKSAR [2002] 2 HKLRD 612. Generally, there could be no retrospective criminal offence or penalties in Hong Kong. A person is not guilty of any criminal offence which did not constitute a criminal offence at the time it was committed: Hong Kong Bill of Rights Ordinance (Cap 383) art 12; The Queen v Chan Suen Hay (HCAL 154A/99, unreported).
