| 释义 | 造意 Lat – a guilty mind. The state of mind required to constitute a particular crime; the mental element of an offence: HKSAR v Ho Chun Bong [2002] 3 HKLRD 452. Generally, every crime requires a mental element, which varies depending on the nature of the crime: HKSAR v Lee Man Yee [1999] 4 HKC 251. There may be one or more mental elements of an offence and it may include intention, recklessness, negligence, dishonesty, or malice. Mens rea is implied in every statutory offence unless, as a matter of construction of the statute, it is excluded expressly or by clear implication: Gammon (Hong Kong) Ltd v A-G [1985] 2 HKC 661, 1 AC 1 (PC). Generally, the onus of proving means rea is on the prosecution: R v Steane [1947] KB 997, 1 All ER 813 (CCA).
