释义 | 精神紊亂 1. A mental illness; a state of arrested or incomplete development of mind which amounts to a significant impairment of intelligence and social functioning which is associated with abnormally aggressive or seriously irresponsible conduct on the part of the person concerned; psychopathic disorder; or any other disorder or disability of mind which does not amount to mental handicap: Mental Health Ordinance (Cap 136) s 2. Mental disorder may arise from illness, injury, congenital defect, ingestion of alcohol or other drug: Lombard Finance Ltd v Brookplain Trading Ltd [1991] 2 All ER 762, 1 WLR 271 (CA). The property of a person suffering from mental disorder is protected and administered by the Court of First Instance, and any unlawful interference with the property of such person is a contempt of court: ss 7–28. 2. Where an employer is suffering from mental disorder such an employer cannot, as a general rule, be made liable for the acts of persons purporting to act on behalf of such an employer: Richardson v Du Bois (1869) LR 5 QB 51. 3. A contract for the sale of land made between parties capable of contracting at the time is not avoided by the fact that either party becomes mentally disordered before completion: Hall v Warren (1804) 9 Ves 605.
