释义 | 勒索罪 An unwarranted demand of money with menaces: Theft Ordinance (Cap 210) s 23. ‘Menaces’ must be of such a nature and extent that the mind of an ordinary person of normal stability and courage might be influenced or made apprehensive so as to accede unwillingly to the demand: R v Pak Wing Piu [1973-1976] HKC 439 (HC); R v Tsang Cheung Keung [1977-1979] HKC 519 (HC). It was not necessary that the menaces actually be made directly to the intended victim. It was sufficient that, in the ordinary and natural course of things, the accused would have expected those menaces to be communicated to the intended victim: R v Tsang Yip Fong [1993] 1 HKC 308 (CA). Goods obtained by blackmail are stolen goods under the Theft Ordinance (Cap 210) s 26(4): R v Lam Chiu Va [1996] 1 HKC 302 (HC).
