| 释义 | 不利 Prejudice, loss, or material disadvantage. Civil and political rights - Less favourable treatment, injury, damage or loss suffered. It is unlawful for a person, in the case of a woman employed by that person at an establishment in Hong Kong, to subject her to dismissal or any other detriment: Sex Discrimination Ordinance (Cap 480) s 11. ‘Detriment’ implies some unpleasantness or burden or less favourable treatment, there is no detriment in failing to provide a specific advantage: Clymo v Wandsworth London Borough Council [1989] 2 CMLR 577, ICR 250. For sexual harassment to amount to detriment, there is no requirement that the conduct should persist over a period of time; a single act, provided it is sufficiently serious, is enough: Bracebridge Engineering Ltd v Darby [1990] IRLR 3. Contract - Material advantage or harm suffered by a party who has been induced to enter a contract by another’s representation, promise, or assurance which was subsequently abandoned. It gives rise to a cause of action if loss and damages sustained as a result of entering into a contract on the strength of another’s offer, statement or promise which did not turn out to be true. In order to succeed, one has to show that the offer, statement or promise so relied upon had been clearly made out and acted upon: Ananda Non-Ferrous Metals Ltd v China Resources Metal and Minerals Co Ltd [1994] 1 HKC 204, HKLY 84 (CA).
