释义 | 詳情 1. Details of the material facts alleged in the pleadings, including details of any claim, defence, or other matter pleaded: Phillips v Phillips (1878) 4 QB 127 (CA). The function of particulars is to carry into operation the overriding principle that the litigation between the parties, and particularly the trial, should be conducted fairly, openly and without surprises, and incidentally to reduce costs: Astrovlanis Cia Naviera SA v Linard [1972] 2 QB 611, 2 All ER 647 (CA). Particulars enable the other party to decide what evidence he ought to prepare for the trial: Thorp v Holdsworth (1876) 3 Ch D 637. In the case of failure to plead other particulars, the court has a discretion in an appropriate case to order that they be supplied: The Rules of the High Court (Cap 4A) O 18 r 12(3). 2. In criminal pleadings, the factual allegations in an information, charge, or indictment indicating the time when, the place where, and the manner in which it is alleged that the offence occurred. Where the trial judge is of the view that the indictment does not disclose reasonable information as to the nature of the charge, he may order the prosecution to give further and better particulars: Indictment Rules (Cap 221C) r 3(3); Chow Hei v R [1960] HKLR 37 (FC); R v Leung Yuen [1963] HKLR 154. The court should amend any discrepancy or defect in ‘substance or form’ if there is no injustice: Magistrate Ordinance (Cap 227) s 27. If the court is satisfied that the defendant was prejudiced by the terms of the charge, for example, misstatement of date and location in the charge sheet, this may result in a quash of conviction: HKSAR v Adeola [2002] 3 HKC 80; R v Chiu Yuk Ching [1985] 2 HKC 76. Small variance of time and place shall not be deemed material: Magistrates Ordinance (Cap 227) s 23; R v Wong Kei Lung & Anor [1994] 1 HKCLR 79.
