A substance or thing which, by virtue of its quality, nature, or the amount administered, is sufficient to injure, aggrieve, or annoy, and thus the substance need not be harmful to bodily health: R v Marcus [1981] 2 All ER 833, 73 Cr App Rep 49 (CA). The substance may be noxious even if it is harmless in small quantities: R v Marcus, supra. The noxious nature of the substance may be inferred from the effect on the person on whom it is administered: R v Hollis (1873) 28 LT 455, 12 Cox CC 463 (CCR). A noxious substance that may cause death or serious bodily harm is regarded as a restricted article on the plane: Aviation Security Ordinance (Cap 494) s 2. See also Poison.
