An implied intention attributed by a court where there is no evidence of a specific intention. See also Impute; Intention.
Contract - The implication of terms into the contract between the parties by the court where there is any reasonable doubt whether the parties did intend to enter into such a contract. Whether a term will be implied is a question of law for the court. A term ought not to be implied unless it is clear that the parties must have intended that there should be the suggested stipulation: Halsbury’s Laws of Hong Kong, Vol 7, Contract [115.154]. Criminal law - The mental element attributed and ascribed to the accused by the court where there is no evidence of specific intent but the accused’s conduct was deliberate and the offence was the natural and probable consequence of that course of conduct. See also Impute; Intention.
