| 释义 | 國旗 The flag or flags carried by a ship to show its nationality or place of registration, that is the country or territory in which it is registered. The proper colours of a ship registered in the Hong Kong SAR are the national flag of the People’s Republic of China and the regional flag of the Hong Kong SAR: Merchant Shipping (Registration) Ordinance (Cap 415) sch 1. Hong Kong SAR registered ships must, on entering and leaving any port, fly the proper colours: s 37(2). They must be flown at or as near as practicable to the stern of the ship. It is an offence for a master to fly the proper flags of a Hong Kong SAR registered ship when the ship is not a Hong Kong SAR registered ship although by custom it is a courtesy to fly the flag of the country or territory visited, in addition to the ship’s own national flag or proper colours, when entering or leaving a port in that country or territory. The specifications for the national flag are set out in the National Flag and National Emblem Ordinance (Cap 2401) sch 1. Certain commercial uses of the national flag are prohibited: s 6. Desecration of the national flag is a criminal offence: s 7; HKSAR v Ng Kung Siu & Anor [2000] 1 HKC 117 (CFA).
