| 释义 | 不適當的訴訟地 Place of jurisdiction which is unsuitable for deciding a matter. The court will choose the forum in which the case can be tried more suitably for the interests of all the parties and for the end of justice. In considering whether there is another forum which is more appropriate the court will look for that forum with which the action has the most real and substantial connection, eg in terms of convenience or expense, availability of witnesses, the law governing the relevant transaction, and the places where the parties reside or carry on business: Spiliada Maritime Corp v Consulex Ltd (The Spiliada) [1986] AC 460 (HL). The court has power to stay proceedings on the ground that a foreign court is the forum conveniens. In this regard, the court has to consider not only if Hong Kong is not the natural and appropriate forum for the trial, but also that if there is another available forum which is clearly or distinctly more appropriate than Hong Kong; and, if so, whether a trial at the other forum deprives the plaintiff of any legitimate personal or juridical advantages: The owners of the ship or vessel “Lanka Athula” v The owners of cargo lately laden on board the ship or vessel “Lanka Muditha” [1991] 1 HKLR 741 (CA).
